Welcome to 89 BLACK. These Terms of Service ("Terms") govern your use of 89black.com and any purchases you make from us. By using this site or placing an order, you agree to these Terms.

If you don't agree with any part of these Terms, please don't use the site.

1. Who we are

2. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years old, or have the permission of a parent or guardian
  • You are legally capable of entering into a binding contract
  • The information you provide (name, address, payment details) is accurate

3. Products

  • All products on 89black.com are printed on demand by our fulfilment partner (Printful). This means each item is made specifically for your order.
  • We do our best to show products accurately (colours, fit, sizing) but minor variations are possible due to the nature of print-on-demand manufacturing, screen calibration, and fabric variations between batches.
  • Sizes follow standard measurements provided by the garment supplier. We recommend checking each product's size chart before ordering.
  • Stock and availability may change without notice.

4. Prices and payment

  • All prices are in Pounds Sterling and include VAT where applicable.
  • We reserve the right to change prices at any time, but the price shown at checkout is what you will be charged.
  • Payment is taken at the point of order via Stripe (card payments) or PayPal.
  • Your order is not confirmed until payment has been authorised.
  • If a price is obviously wrong (e.g. listed at £1 when it should be £25 due to a pricing error), we reserve the right to cancel the order and issue a full refund.

5. Placing an order

When you place an order, you are making an offer to buy. We'll confirm receipt by email. A contract is formed between you and us when we send you the order confirmation.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

  • Orders suspected of fraud
  • Orders that cannot be fulfilled due to product availability
  • Orders where payment verification fails
  • Orders that breach these Terms

If we cancel your order, we'll refund any payment in full.

6. Shipping

  • Full shipping information is available on our Shipping Policy page.
  • Shipping times are estimates, not guarantees. Most orders ship within 5-10 business days, but delays can happen (especially around peak seasons).
  • Once your order ships, risk of loss transfers to the carrier. We're not liable for lost or damaged items after they leave Printful's facility — but we will help you claim against the carrier if needed.

7. Returns and refunds

Because our products are printed on demand specifically for you, we have a limited returns policy. Full details on the Returns & Refunds page.

In short: we only accept returns for defective products or mistakes on our part (wrong item, wrong size from what you ordered, misprints). We do not accept returns for reasons like "didn't fit" or "changed my mind" — please check sizing before ordering.

8. Intellectual property

  • All designs, images, logos, and content on 89black.com are owned by 89 BLACK or used with permission.
  • You may not reproduce, copy, or resell our designs without explicit written permission.
  • When you buy a product, you're buying the physical item, not the rights to the design.

9. Use of the site

You agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the site
  • Use automated tools (bots, scrapers) to access the site in a way that could disrupt it
  • Submit false or misleading information
  • Interfere with other users' use of the site

10. Your account

If you create an account:

  • You are responsible for keeping your password secure
  • You are responsible for all activity under your account
  • Notify us immediately if you suspect unauthorised access
  • We may suspend or delete accounts that breach these Terms

11. Limitation of liability

To the fullest extent permitted by law:

  • We provide the site "as is" and make no warranties about uninterrupted or error-free operation
  • Our liability for any claim relating to an order is limited to the amount you paid for that order
  • We are not liable for indirect, incidental, or consequential damages
  • Nothing in these Terms limits your statutory consumer rights under UK law

12. Consumer rights

If you're a consumer in the UK or EU, nothing in these Terms affects your statutory rights, including rights under:

  • The Consumer Rights Act 2015
  • The Consumer Contracts Regulations 2013

For non-defective print-on-demand products, the standard 14-day cooling-off period under Consumer Contracts Regulations does not apply, because our products are made to order specifically for you (regulation 28(1)(c) — goods made to the consumer's specifications or clearly personalised).

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to these Terms

We may update these Terms occasionally. The "last updated" date will reflect the most recent change. Continued use of the site after changes means you accept the new Terms.
